These Terms of Service ("Terms") govern your use of the agent app, the agent website, and the public property pages provided by Aqar Lagta ("the Platform" or "we"). By creating an account or using the Platform, you enter into a binding agreement with us and agree to these Terms.
1. Acceptance and Eligibility
By using the Platform you represent that you are at least 18 years old, legally capable of entering into this agreement, and — where the law requires — licensed or authorised to practice real-estate brokerage in your area of business.
If you do not agree to these Terms, you may not use the Platform.
2. Description of the Service
The Platform provides agents with tools to create and manage property listings, generate shareable short links, receive buyer inquiries via WhatsApp or the inquiry form, manage lead records, post listings to Facebook, and receive notifications. It also lets buyers browse public property pages and contact agents.
3. Agent Responsibilities
The agent agrees to:
- Keep the information provided accurate and up to date, with the location, price, and specifications reflecting the property truthfully.
- Own the rights to the media uploaded, or have the right to use them for publication.
- Comply with the policies of connected services (WhatsApp and Facebook) and with customer-communication rules, and not use misleading or harassing methods.
- Not publish content that is unlawful, fraudulent, discriminatory, or that infringes the rights of others.
4. User Conduct
No user may:
- Misuse the Platform or attempt unauthorised access to its systems or data.
- Collect other users’ data automatically or by any unauthorised means.
- Interfere with the Platform or place undue load on its infrastructure.
- Impersonate any party or mislead buyers or other agents.
5. Accounts and Authentication
An agent account is created using a mobile number and verified by an OTP sent via WhatsApp. You are responsible for the accuracy of your number, for keeping access to your device confidential, and for all activity from your account. Notify us immediately of any unauthorised use.
6. Content and Intellectual Property
Ownership of content an agent uploads (text, images, video) remains with the agent. By publishing, you grant Aqar Lagta a worldwide, non-exclusive, royalty-free licence to use the content for the purpose of displaying it on the Platform, distributing it via short links, and posting it to the linked social pages at your request.
Aqar Lagta retains all intellectual-property rights in the Platform itself (marks, designs, code, and interface).
7. Third-Party Services and Integrations
The Platform relies on WhatsApp, Facebook, and other services. You are responsible for complying with each service’s terms when you connect it to your account, and you bear the consequences of any action those providers take (such as suspending or cancelling your account with them). We do not guarantee the continued availability of any third-party service and may disable an integration if it violates their policies or ours.
8. Prohibited Uses
The Platform may not be used for any unlawful, fraudulent, or harmful activity, to publish misleading information, or to infringe any party’s intellectual-property or privacy rights. We may remove non-compliant content and suspend or terminate accounts.
9. Disclaimer and Warranties
The Platform is provided "as is" without warranty of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that results will meet your expectations. You use the Platform at your own risk.
10. Limitation of Liability
To the extent permitted by law, neither Aqar Lagta nor its directors, employees, or processors shall be liable for any indirect, incidental, or consequential damages, or for loss of profits or data, arising from your use of or inability to use the Platform. Nothing in this section is intended to override mandatory law in your country.
11. Indemnity
You agree to indemnify and hold Aqar Lagta harmless from any claims, losses, or damages arising out of your breach of these Terms, your misuse of the Platform, or your infringement of the rights of others.
12. Suspension and Termination
We may suspend or terminate your account or remove content at any time and for any reason, including breach of these Terms. You may terminate your account at any time by requesting deletion from the app settings or by contacting us. Provisions that by their nature survive termination (intellectual property, indemnity, limitation of liability) remain in effect.
13. Future Paid Features
The Platform is currently free. We may later introduce subscriptions or paid features. When any paid feature launches, we will publish clear payment, billing, auto-renewal, and refund terms before it is activated, and your use of it will be subject to separate terms you agree to at purchase.
14. Modifications to the Terms
We may modify these Terms from time to time. We will post the revised version here with an updated "Last updated" date, and may notify you of material changes. Your continued use of the Platform after a modification constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or relating to them, are governed by the laws of the State of Wyoming, USA, and are referred to the state and federal courts located in Wyoming, which shall have exclusive jurisdiction.
If any provision is unenforceable in your country, it will be interpreted or excised to the extent necessary, with the remaining Terms staying in effect.
